Did not take long for the Feds to start utilizing their new police power on copyright: Student to face US trial over TVShack website - Crime - UK - The Independent Of course if you are Google or Yahoo, links to other websites with copyright material is not prosecuted. With respect to the case, currently under U.S. Federal Law, if the student has never traveled or visited the United States, no U.S. Federal Court can bring this case to trial. Why? Under procedural laws, the U.S. Court must have both subject matter (i.e., copyright infringement) and personal jurisdiction(i.e., the person lives, committed the alleged crime or travels in the United States) over the persons subject to the case. Thus, if this student has never been to the U.S., then a motion to dismiss for lack of personal jurisdiction will be granted. Because of this procedural issue, that is why the Feds are requesting extradiction of this student so they can satisfy the personal jurisdiction requirement. The real question here is what are the requirements for a UK Court to grant an extradiction order, were they satisfied and whether the law is legal under UK law. |
